Three Miami boys, aged 12 to 15, have been charged as adults following a horrific sexual assault on a 12-year-old girl last summer. Nelson Nunez, 13, Jusiah Jones, 12, and Xavier Tyson, 15, now face multiple felony charges after a grand jury deemed the case too serious for juvenile court.

Violent Assault Rocks Miami Community Garden

The attack happened on June 18, 2025, at The Green Haven Project community garden near Frederick Douglass Elementary School in the Overtown neighbourhood. Police initially arrested the boys on juvenile charges the next day, but renewed scrutiny pushed prosecutors to upgrade to adults.

Witnesses, Evidence, and Harrowing Details

A local woman heard screams and saw the victim afterward, quickly alerting authorities. She recorded a phone call with a witness who described Tyson pulling down the girl’s clothing despite her pleas. A fourth boy was present but reportedly did not join the assault. The witness said he didn’t step in — fearing violence if he did.

Charges and Court Appearances

All three suspects face false imprisonment charges. Nunez and Jones are charged with sexual battery, while Nunez also faces kidnapping. Tyson is charged with lewd and lascivious molestation of a child. Jones and Nunez appeared in adult bond court Friday and were held without bail.

Mike Vega of Miami PD said the decision to try the boys as adults highlights the brutal nature of the crimes and Florida’s tough juvenile justice rules.
