Her Honour Judge Sarah Munro KC has been appointed to chair the public inquiry into the shocking miscarriage of justice against Andrew Malkinson, who spent 17 years behind bars for a crime he did not commit, followed by three years on probation.
The inquiry will investigate the roles played by Greater Manchester Police (GMP), the Crown Prosecution Service (CPS), and the Criminal Cases Review Commission (CCRC) in convicting and failing to clear Malkinson. All agencies have pledged full cooperation to ensure a thorough review.
Lord Chancellor Alex Chalk said: “Mr. Malkinson suffered an atrocious miscarriage of justice, and I am determined to ensure that he and the original victim get the answers they deserve.”
Judge Munro, a senior figure with extensive criminal law experience, described it as an honour to chair the inquiry. She promised a fearless and robust investigation into how Malkinson’s life was devastated by wrongful convictions.
The inquiry’s remit includes police investigations, the criminal trial, appeals, and any other factors linked to the failure of justice, while protecting ongoing police and Independent Office for Police Conduct (IOPC) investigations.
The government has chosen a non-statutory inquiry to maintain flexibility and speed, aiming to avoid lengthy delays. Judge Munro is expected to produce findings quickly. The final report, including recommendations, will be submitted to the Lord Chancellor and published publicly.
Greater Manchester Police Chief Constable Stephen Watson said: “We are committed to a transparent and thorough investigation and offer our apologies to Mr. Malkinson for the anguish he has endured.”
