A Man Was Sentenced To 12 Years In Prison After Being Found Guilty Of Raping And Sexually Assaulting His Former Partner And Her Son

The 56-year-old man, who cannot be identified to protect the anonymity of his victims, was found guilty by a jury following a trial earlier this year at the Central Criminal Court of 61 counts, including two counts of raping his then-partner and 52 counts of sexually assaulting her.
He was also convicted of four counts of sexual assault on her son and one count of rape on the boy, who was between the ages of nine and eleven at the time.
The man was also found guilty on two counts of cruelty to his ex-children. partner’s
The offences occurred between October 2013 and December 2015.
The defendant refuses to accept the verdict and maintains his innocence.
He has no prior convictions and intends to appeal his conviction, according to the court today.
The defendant provided the court with eleven character references.
These included statements from friends, neighbours, and coworkers, with several references describing the man as a “caring father” and a good friend.
In her victim impact statement, the woman stated that before meeting the man, she was a “strong and independent” woman, but he had taken that away from her.
She claimed he appeared nice at the beginning of their relationship, but this was “all for show.”
She claimed she did everything she could to protect her children, but it was impossible because the defendant, whom she described as a “sick monster,” was always in charge.
Mr Justice Michael McGrath, who handed down the sentence, described the defendant’s behaviour as “emotionally and physically oppressive.”
Rape, he said, “invades the dignity of the victim,” and this incident occurred against the backdrop of sexual assault.
The judge went on to say that the rape and sexual assault of her son involved a “breach of trust” by a man the boy considered to be a father figure.
According to Mr. Justice McGrath, the victim’s children were young and vulnerable.
Because of his “oppressive and cruel” behaviour, the defendant had instilled fear in them.
According to the court, the defendant and the woman were in a relationship and had four young children.
The defendant raped his then-partner on a date between September and December 2015, around Halloween 2013. Throughout 2015, he sexually assaulted her on a weekly basis.
Previously, the court heard evidence that the defendant raped the woman’s son.
He also sexually assaulted the boy after sports practice in the shower.
The defendant expected the children to clean the house at any time of day or night.
He also locked all of the internal doors and required permission to use the bathroom.
The defendant’s outbursts of rage and interference with the victim’s homework were also witnessed by the victim’s daughter.
In reference to the victim impact statements, Mr Justice McGrath stated that the victim’s daughter described herself as “living in prison” and was convinced that no one would believe her.
Because of the secret, he was carrying, the victim’s son felt like an outsider in his family, according to the judge.
He claimed that the defendant’s actions had harmed her self-esteem and self-respect and that his desire for power made it impossible for her to protect her children.
Mr Justice McGrath stated that he had considered the defendant’s character references, which spoke of his good standing in the community.
“They also highlight the often hidden nature of domestic violence,” Mr Justice McGrath added.
Mr Justice McGrath stated that it was not appropriate to suspend a portion of the sentence because the defendant had shown no remorse. He pushed the sentence back to March 23.
He also issued the defendant a 12-month post-release supervision order.
During an earlier sentence hearing, prosecutor Shane Costello SC read out victim impact statements made by the accused’s former partner, her son and daughter.
For his actions toward her “innocent” son, the defendant’s ex-partner referred to him as a “sick monster.”
Following the end of the relationship, the defendant stalked her, terrifying her.
In her victim impact statement, her daughter, now in her twenties, stated that the defendant never showed her affection and that the family home was like a “prison.”
No child should have felt like I did,” her son, now 19, said in court, reading his own victim impact statement.
