Shamima Begum’s fight to regain her British citizenship has returned to the spotlight at the Court of Appeal in London. The 24-year-old, who left the UK at age 15 to join the Islamic State in Syria, had her UK citizenship revoked in 2019 on national security grounds.
Begum’s citizenship was stripped after she was discovered in a refugee camp in Syria. The UK government cited national security concerns and a “credible suspicion” of her involvement in sexual exploitation activities linked to ISIS. Earlier this year, the Special Immigration Appeals Commission (SIAC) upheld the citizenship revocation, preventing her from returning to the UK.
Begum’s legal team argues that the Home Office failed to properly consider her as a potential victim of trafficking, which is a key point in her appeal. Samantha Knights KC, representing Begum, stated that “trafficking was a mandatory, relevant consideration” that was overlooked, rendering the citizenship revocation unlawful.
Knights also pointed to SIAC’s observation of “arguable breaches of duty” by the Metropolitan Police, Tower Hamlets council, and Begum’s school. These organisations are alleged to have failed in their responsibilities to protect her, potentially contributing to her exploitation.
The Home Office denies any wrongdoing but now faces increased scrutiny over its decision-making process and whether it adequately addressed Begum’s claims of kidnapping and trafficking. The case is ongoing, with a final verdict awaited by many.
