The conclusion of a two-day police misconduct hearing concerning PC Jack Oliver has resulted in a detailed assessment of the allegations levelled against him and their subsequent resolution. The hearing, chaired by Dale Simon and held on the 8th and 9th of April 2024 at Suton Police Station, SM1 4RF, involved a panel consisting of Superintendent Lora John (Assessor) and Margie Leong (Independent Member) alongside Dale Simon (LQC).
PC Oliver faced allegations stemming from an incident on 1st August 2022, wherein he was stopped by British Transport Police (BTP) officers at Norbury British Rail Station. The allegations accused him of dishonestly evading fare payment by utilizing his Police issue Oyster Card (PO Card) at a station not covered by Transport for London (TFL) services.
During the hearing, evidence was presented, including a video recording from a BTP body-worn camera and oral testimony from PC Oliver. The panel meticulously examined the facts, weighing them against the standard of proof required for such cases, which is the balance of probabilities.
The allegations against PC Oliver primarily revolved around the issue of dishonesty. However, the panel concluded that the evidence presented by the Metropolitan Police Service (the AA) failed to establish, to the required standard, that PC Oliver had acted dishonestly. Despite acknowledging certain lapses in PC Oliver’s behaviour, such as their failure to thoroughly read the documentation and his decision to push through the barrier at Norbury station, the panel ultimately found that his admitted actions did not amount to misconduct or gross misconduct.
Consequently, the panel recommended that PC Oliver undergo the Reflective Practice Review Process, highlighting areas where his conduct could be improved to meet the professional standards expected of a police officer.
In light of the hearing’s outcome, PC Oliver has been absolved of the allegations brought against him, with the panel’s findings emphasizing the importance of thorough consideration of evidence and adherence to the highest standards of professional conduct within the police force.
